ERISA Views (Quarterly Newsletter on a Featured Topic). The latest issue (Summer 2010 - Issue #58) focuses on the fee disclosure regulations issued by the Department of Labor on July 16, and which become effective one year later (July 16, 2011). The newsletter is divided into 5 sections: (1) how the fee disclosure rules are enforced, (2) who is a "covered service provider" that must provide the required dislocusres, (3) the timing of the disclosures, (4) the required content of the disclosures, and (5) exemptive relief for plan fiduciaries if a service provider fails to comply with the disclosure requirements and the fiduciary satisfies certain requirements. eRISA Update (Quarterly Current Developments Service): eRISA Update is an electronic current developments service, providing comprehensive summaries of all the important developments in the retirement plan area. The latest issue, Issue #31 (Summer 2010), provides, in addition to a summary of the Pension Relief Act of 2010, summaries of: (1) final Treasury regulations under IRC §401(a)(35), relating to diversification requirements for defined contribution plans that hold publicly-traded employer securities, (2) an alternative signing procedure under DOL's new electronic filing system for Form 5500s (EFAST2), under which a third party service provider is able to sign to return/report on a client's behalf, (3) final DOL regulations clarifying the timing rules for qualified domestic relations orders (QDROs), (4) IRS' extension of the "two year window" for restating prototype and volume submitter defined contribution plans for plans affected by various storms and severe weather in eight different States, (5) two Supreme Court cases - one dealing with the standard of review when a plan administrator must make a new interpretation of a plan document because its initial determination was unreasonable, and another that rejects the requirement that an ERISA litigant must be a "prevailing party" before a court may consider awarding attorney's fees, provided that the attorney's fee claimant has had "some degree of success on the merits," (6) an equitable estoppel case from the Sixth Circuit which allowed a case to proceed that seeks payment of benefits in accordance with a certified benefits statement furnished by the plan that overstated the retiring participant's benefits, (7) a Third Circuit case holding that unsolicited comments by an employee regarding alleged plan violations are not within the scope of ERISA's anti-retaliation statute (ERISA §510), (8) "Box 5" relief provided by the PBGC to certain plans that elected to use the alternative premium funding target election on PBGC's comprehensive premium payment form, (9) modifications to a prohibited transaction class exemption (PTE 2003-39), pertaining to certain releases of claims held by an employee benefit plan against a party-in-interest, and (10) proposed modifications to another prohibited transaction class exemption (PTE 96-23) for in-house asset managers ("INHAMs").
